What Can be Reported?

Situations of discrimination in fact and in law on grounds of gender occurring in employment relationships

Who Can Lodge a Complaint?

Individuals or public or private bodies who believe that the principle of non-discrimination on the grounds of sex has been violated.

Where Should a Complaint be Lodged?

Declarations are sent to the Instituto de la Mujer (Institute for Women) or can be presented in Centros de Información de los Derechos de la Mujer (Women's Rights Information Centres) attached to the Institute, which are located in Madrid, Santander and Seville. These centres are intended for women and can be contacted by telephone, post or in person.

The service is always free of charge

A national 24-hour telephone service for women is available free of charge every day of the year and provides information on general legal matters - problems of sexual harassment - employment and social resources guidance.

The telephone number is: 

  • Tel: 900 191 010 and 
  • Tel: 900 152 152 for deaf women.

Sexual harassment in the workplace, considered as a crime in the Penal Code, is punished by arrest of six to 12 weekends or a fine of three to six months (minimum fine of €108.18 and maximum fine of €54 091.09). This penalty may be more severe if certain conditions converge and the arrest may be 12 to 24 weekends or a fine of six to 12 months (minimum fine of €216.36 and maximum fine of €108,182.18).

Commission Recommendation 92/131/EEC of 1991 promotes the practical code of conduct for the dignity of men and women at work and recommends its use to the Member States.
